Civil Rights Defense

PDF

For over 20 years, our attorneys have defended and counseled Oregon cities, counties, special districts, school districts, governmental agencies, and individuals in complex civil rights and constitutional cases, from inception, through trial, and on appeal.

We defend all types of civil rights and constitutional claims, and understand the many nuances of cases brought under 42 U.S.C. § 1983, Title VII and Title IX, and under Oregon law. Our defense attorneys have litigated numerous cases alleging violations of the First, Fourth, Eighth, and Fourteenth Amendments, including claims of free speech retaliation, deprivation of procedural and substantive due process, equal protection, as well as those alleging wrongful arrest, excessive force, malicious prosecution, deprivation of prisoner rights, and many others.

We know the law, and pride ourselves on our ability to quickly investigate and analyze the facts. We often are hired to assist municipalities in analyzing claims before they are filed, and to create a litigation plan to negotiate a settlement or take the case to trial. We have also resolved many of these cases at the motion to dismiss or summary judgment stage.
